1. Acceptance of These Terms

These Terms of Service (the “Terms”) govern your access to and use of the crowshard.ink website (the “Site”) and any educational content, course materials, checklists, templates, and communications provided through it (collectively, the “Services”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.

You must be at least 16 years old to use the Site. If you are under the age of majority in your jurisdiction, you may use the Site only with the involvement and supervision of a parent or legal guardian. You represent that you have the capacity to enter into a binding agreement and that your use complies with applicable law.

2. Educational and Safety Disclaimers

crowshard.ink provides educational information about smartphone repair, device diagnostics, and the operational setup of a mobile phone service center. The Services are provided for learning purposes only. They do not constitute professional advice, and they are not a substitute for manufacturer documentation, official service manuals, product safety instructions, or formal vocational training where required.

Repair work carries inherent risks, including but not limited to device damage, electric shock, burns, cuts, chemical exposure, lithium battery swelling or thermal events, and data loss. You are solely responsible for implementing appropriate safety controls such as ESD precautions, safe battery handling, ventilation, eye protection, and safe tool use. You are also responsible for verifying local legal requirements, warranty terms, and consumer-protection obligations that apply to your repair activities.

We do not guarantee that following any lesson, checklist, or template will produce a successful repair outcome or any business result. Outcomes depend on many factors, including the condition of a device, hidden damage, part quality, tool calibration, technician practice volume, and operational discipline.

3. Description of the Services

The Services may include educational modules, written procedures, diagnostic flows, quality-control scripts, intake and handover guidance, and business operations material related to running a repair workshop. We may update, refine, or discontinue any part of the Services at any time to keep the curriculum consistent with common device changes and workshop practices.

The Site is provided on an “as is” and “as available” basis. Availability may be affected by maintenance, upgrades, network issues, or third-party service providers. We do not promise uninterrupted access or error-free operation.

4. Acceptable Use

You agree to use the Site responsibly and lawfully. In particular, you must not:

  • Attempt to access non-public areas of the Site, bypass security controls, or probe for vulnerabilities.
  • Use automated means (scraping, crawling, or harvesting) to extract content or data without our prior written consent.
  • Upload, transmit, or distribute malware, phishing content, or any material designed to disrupt the Site or harm others.
  • Provide false or misleading information in registration or contact forms, or impersonate another person or entity.
  • Use the Site to send unsolicited marketing, bulk messages, or other spam.
  • Use the Site in violation of sanctions, export controls, or other restrictions that may apply in your jurisdiction.

If we reasonably believe that you have violated these Terms, we may restrict or terminate your access to the Site to protect our users, our systems, and our rights.

5. Intellectual Property

The Site and all content and materials provided through the Services, including text, structure, curriculum design, checklists, templates, branding, and underlying code, are owned by MOBILE ELEMENTS (ACCESSORIES) Ltd or its licensors and are protected by intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal learning or internal business training purposes. You may not copy, reproduce, distribute, publicly display, modify, create derivative works, or commercially exploit the Services without our prior written permission.

You may reference general concepts learned from the Services in your own work. However, you may not republish our templates or course materials as your own educational product, resell them, or make them available to third parties in a way that substitutes for the Services.

6. Third-Party Services and Links

The Site may rely on third-party infrastructure and may reference external resources for context. We are not responsible for third-party content, availability, or practices. Your dealings with third parties are between you and the third party, governed by their terms and policies.

7. Disclaimer of Warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant that the Services will meet your requirements, that they will be uninterrupted, or that defects will be corrected.

Any reliance on repair techniques, diagnostics steps, or business guidance is at your own risk. You are responsible for verifying applicability to the device model in front of you, the tools you use, and the local consumer and safety obligations relevant to your work.

8. Limitation of Liability

To the fullest extent permitted by law, MOBILE ELEMENTS (ACCESSORIES) Ltd and its directors, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising from or related to your use of (or inability to use) the Services.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services is limited to the greater of (a) the amount you paid to us for the Services in the 12 months preceding the event giving rise to the claim, or (b) ÂŁ100.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

9. Indemnification

You agree to indemnify and hold harmless MOBILE ELEMENTS (ACCESSORIES) Ltd from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your misuse of the Services; (b) your violation of these Terms; (c) your repair services or business operations; or (d) your infringement of any third-party rights.

10. Force Majeure

We are not responsible for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, severe weather, war, terrorism, civil unrest, public health emergencies, labour disputes, internet outages, cyberattacks, failures of hosting or cloud providers, or interruptions to telecommunications services.

11. International Use

The Services are operated from the United Kingdom. We make no representation that the Services are appropriate or legally available in every jurisdiction. You are responsible for compliance with laws applicable to you, including consumer rights, safety rules, and any licensing requirements related to electronics repair in your location.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Subject to mandatory consumer protections that may apply, the courts of London, England will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.

13. Dispute Resolution

Before starting formal legal proceedings, you agree to contact us and allow a reasonable 30-day period for informal resolution. This does not limit your rights under applicable consumer law.

14. Termination

We may suspend or terminate access to the Services if you violate these Terms or if we reasonably believe your use creates a security, legal, or operational risk. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

15. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be interpreted to reflect the original intent as closely as permitted by law.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and MOBILE ELEMENTS (ACCESSORIES) Ltd regarding your use of the Site and the Services and supersede any prior or contemporaneous agreements on the same subject.

17. Assignment

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, restructuring, or sale of assets. You may not assign these Terms without our prior written consent.

18. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision. Any waiver must be in writing and signed by an authorised representative of MOBILE ELEMENTS (ACCESSORIES) Ltd.

19. Modifications to These Terms

We may update these Terms from time to time. Changes become effective 14 days after they are posted on this page, unless a change is required by law or is necessary to address an urgent security or operational issue. Your continued use of the Site after the effective date means you accept the updated Terms.

20. Electronic Communications

You agree that communications we provide to you electronically satisfy any legal requirement that such communications be in writing. Where applicable, electronic signatures and electronic records will be treated as binding under relevant electronic communications laws.
